Expungements:

A criminal record can impact a person’s ability to get a job, obtain a loan, and/or receive a professional license or certification. In the event that you have a criminal record that is affecting your ability to move on with your life, you should call a knowledgeable attorney to learn whether you might be entitled to have your record expunged. If you are deemed eligible to have your record expunged and an Expungement is granted, your criminal record will be cleared of the offenses involved.

The instances in which a person may be entitled to have their record expunged include the following:

  • The charges were dropped or dismissed
  • The Defendant was found “not guilty” after a trial
  • The crime was committed when the Defendant was a juvenile
  • The Defendant successfully completed ARD or some other Diversionary Program.
  • The Defendant is 70 years old or older and has not been arrested in the last 10 years
  • The Defendant is dead
  • The arrest was for a Summary Offense and 5 years have expired since the person was convicted of the offense.

In the event that you may be entitled to have your criminal record expunged of a previous crime, a proper Petition for Expungement will need to be filed, asking that a Judge sign an Expungement Order. After the Order is signed by the Judge, it needs to be sent to certain offices, including the Pennsylvania State Police Central Repository. Those offices will then destroy any records they have regarding your arrest.
