Mediation is a process by which the parties to a divorce action may resolve their differences without the necessity of going to Court. Typically, the parties will meet with a neutral third party who will act as the Mediator. The Mediator will help the parties agree to a resolution of their divorce-related issues. Depending on the Mediator, and the requests of the parties involved, the agreements reached by the parties in Mediation can be made part of their divorce decree. In some instances, the Mediator will take responsibility for drafting the Property Settlement Agreement. The Property Settlement Agreement is the operative document in a divorce which includes the terms of the parties’ agreement to resolve the divorce. In other instances, the Mediator will prepare a “memorandum” that the parties may take to their individual attorneys.
Mediation is a consensual process which requires the devotion and assent of each of the parties. The goal of Mediation is to aid the parties in coming to an agreement on their own. The Mediator makes suggestions and observations, but does not create or dictate the terms of the parties’ agreement.
